1.  Introduction
1.1 earlybird.dk processes personal information about you. Hence, you may read the information regarding our privacy and cookie policy in the following (Privacy Notice).
Earlybird.dk is committed to protecting our customer's personal information. We are taking our responsibility for the safety of customer information very seriously. We are clear and transparent regarding the information we collect and what we do with this information.

This policy includes the following:
What personal data we collect and process concerning your relationship with us as a customer and through your use of our website, mobile applications and online services;

- Where we get the data from;
- What we do with this data;
- How we store this data;
- Whom we transfer/share this data with;
- How we relate to your data protection rights;
- Moreover, how we comply with data protection laws.
- All personal data are collected and processed under data protection legislation in Denmark and the EU.


2. Data Manager
2.1 earlybird.dk ApS (CVR: 33393407) is responsible for data collection. Hence, we are responsible for processing your personal information.
 
3. Categories of personal data
3.1 We treat the following categories of personal information about you:

4. The restaurant you have booked
5. The number of people attending the restaurant
6. Which menus and menu prices associated with the booking
7. The order's total purchase price
8. The date and time of the booking
9. The "seating" time of the booking
10. The type of payment card used for booking
11. If used for booking, which Gift Card Code
12. Which computer device and browser type that used for booking
13. If the person who made the booking has used "adBlocker" or not
14. If any, feedback from the guest regarding their experiences at our cooperation restaurants

(b) Personal information provided by you, for example in connection with support requests and customer service. Including the messages, you exchange with us or send directly to us via letters, emails, chat services, and social media.

(c) Responses in User and Satisfaction Surveys

(d) We monitor behavioural patterns on the site to provide a better service and an optimised website

(e) Location, including the real-time location of your computer or device, GPS, Bluetooth, and your IP address, along with the favourite hotspots and telephone locations, if you use location-based features and turn on Location Services settings on your device and computer. Registration of your IP address is part of our system administration, and the IP address does not allow us to identify you as a person.

4. Purpose and basis for the collection of personal data
4.1 We ensure that your personal information is collected and processed solely for one or more of the following purposes:

(a) To deliver products and services that you have ordered; We use the information you provide us to perform the services you have requested in connection with your booking. Besides, we use the information to improve security and prevent fraud and abuse.

Also, we save the information to notify you of changes in our services; for example in case of a change or cancellation. These messages are not for marketing purposes and can not be deselected.

When making a booking via earlybird.dk at a restaurant, earlybird.dk discloses information about you a1-a9. The restaurant can use the information to handle your visit to the restaurant and the restaurant's customer card. We do not use this information for advertising purposes.

Restaurants can receive summary feedback from earlybird.dk from recent guests when earlybird.dks users review restaurants. If you submit comments about a restaurant (through an evaluation via earlybird.dk), these can be exchanged with the restaurant in question.

earlybird.dk only discloses the information specified above to the restaurants you have made reservations at via earlybird.dk. The restaurants do not have access to your booking history at other restaurants. However, you agree that restaurants under the same company or chain may exchange information about your booking history:

(b) To answer any questions or objections you may have;

(c) To respond to your comments, as well as enabling you to participate in competitions or campaigns related to user and satisfaction surveys.

(d) If you have agreed to receive direct marketing: to conduct direct marketing to you per your consent. From time to time we can contact you with information about restaurant deals and additional products via e-communication. You can choose or opt-out to receive such messages by specifying your choice in the booking stage. With every e-communication we send you, you can indicate that you no longer wish to receive our direct marketing material.

(e) To provide you with information about the products and services, similar products and services that you have previously purchased from us or which you have requested; to improve our website, products and services. For this, we use Google Analytics. See section 8.1.

(f) We retain personal information to the extent necessary to comply with the Accounting Act and other legal obligations that Earbird.dk ApS may have.


4.2. Our basis for treatment is as follows:
(a) The processing is necessary for the performance of a contract with which you are a party for the purposes stated in section 4.1. a-c.

(b) The treatment is based on your consent for the purposes stated in section 4.1 d-e. You may withdraw your consent at any time.

(c) The processing is necessary for earlybird.dk to pursue its legitimate interests, in particular, to improve user experience and security, and to prevent fraud and abuse in connection with the purposes set out in paragraphs 4.1a and 4.1f.

(d) The processing is necessary to comply with a legal obligation which is borne by earlybird.dk in connection with the purposes stated in section 4.1 f


4.3. We keep your personal information on the following basis :
(a) and (d) At earlybird.dk ApS, we keep your personal information as long as necessary and permitted under the current laws governing the processing of personal data. We also store and use your information when it is necessary to comply with legal obligations and enforce our agreements. If you wish to correct or delete personal information that we have registered for you, please contact us, see item 10, after which we delete the requested data. Your data is securely stored.

(b) Where processing is made based on your consent, earlybird.dk stores your personal information until you withdraw your consent.

When you consent to receive electronic marketing material, for example, via newsletters to your email address, you will be subscribed to the newsletters from both Early Bird and Special, and we will store your email address until you ask us to delete it. In each newsletter you receive from us, you will also have the option to unsubscribe from the mailing list for respectively Early Bird and Special.

You may at any time contact us at [email protected] and ask for your email address to be deleted.

(c) Where treatment is necessary for earlybird.dk to pursue its legitimate interests, earlybird.dk stores your personal information as long as we have a purposeful purpose of storage.


5. Your data protection rights
5.1 If you have questions regarding our processing of your personal information, please contact us through the contact details described in section 10 below.

5.2 You can access your personal information at any time, request us to correct incorrectly, deleted, or altered contact information by contacting us via the contact details described in item 10. You may also request that processing be limited, data portability or objections to our processing of your personal information.

5.3 If you wish to appeal against our processing of your personal information, please contact the Data Inspectorate.

5.4 You have the right at any time to object to the processing of the personal information we use to do direct marketing.

6. Security of your personal data
6.1 We follow strict security procedures in the storage and disclosure of your personal data and to protect them from accidental loss, destruction or damage. The data you provide us is protected using Secure Socket Layer (SSL) technology. SSL is the industry's default method of encrypting personal information and credit card information so that they can be securely transferred over the Internet.

All payment information is sent over SSL via an encrypted connection.

We may want to disclose your information to trusted third parties for the purposes specified in this Privacy Policy. We require that all third parties have appropriate technical and operational safeguards for the protection of your personal data following Danish and EU data protection rules.

7. Transfer of personal data
We may share your personal data with the following third parties for the purposes described in this Privacy Policy:

7.1 Transfer of your personal information to professional counsellors may happen following the applicable data protection legislation.

7.2 We reserve the right to use or disclose personal data to the extent necessary to comply with applicable data protection law, conduct investigations in connection with complaints, respond to your requests or for investigative purposes.

7.3 We transfer your personal data to data servers following applicable data protection laws, including the conclusion of data processing agreements with our data processor to ensure that personal data is processed for the intended purpose only and ensure appropriate security measures.

7.4 Trusted service providers that we use to run our business, such as cloud service and email marketing service providers, that help our marketing team to conduct customer surveys and deliver targeted marketing campaigns.

7.5 Personal data we have collected from you may be transferred to countries outside the EU / EEA ("EEA"). If we transfer your personal data outside the EEA, we ensure that the transfer either takes place to countries that the EU Commission has established have an adequate level of security or that the transfer is based on the EU Commission's standard provisions. You can always contact the contact details in section 10 for a copy of the transfer basis.

8. Additional conditions
8.1 We use Google Analytics to understand our users' needs better and to optimise our service. Google Analytics is a technology that helps us better understand our users' experience (e.g., how long they spend on which pages, what links they click, what they do or what they do not like, etc.), which enables us to build and maintain our service based on our users' feedback. Google Analytics uses cookies and other technologies to gather data about our users' behavior and their devices (in particular, the device's IP address (collected and stored in anonymized form), device display resolution, device type, browser information, geographic location (country only) , preferred language used to display the site). Google Analytics stores this information in a pseudonymized user profile. Neither Google Analytics nor earlybird.dk ApS will ever use this information to identify individual users or to match with additional data for a specific user.
